BASKING RIDGE==In Kondratowicz v. Newmark, after trial in Kings County Supreme Court, the jury rendered a defense verdict with a finding that the defendants did not violate the New York Labor Law. In the case, the plaintiff, a bricklayer, was injured when a nail from a nail gun ricocheted into his eye during the renovation of a commercial building in Manhattan. The claim was under the New York Labor Law, pursuant to a provision making owners of buildings responsible for a contractor’s failure to provide safety equipment. Schneider argued that the appropriate safety equipment was available and the plaintiff was instructed to use it.
"Although the Labor Law on its face seems difficult to overcome at times, we were able to convince the jury that the accident, while unfortunate, was the fault of no one but the plaintiff himself," said Schneider.
